COMPETITION SUMMARY
Important Notice:
Whilst this competition is currently available all Australian residents other than in Western Australia the following terms and conditions apply ONLY to residents in Victoria.
All other eligible residents of New South Wales, Victoria, Queensland, South Australia, Australian Capital Territory, Northern Territory and Tasmania are covered by a separate set of terms and conditions as set out in Document 1 on this web page.
The competition is being run by Liquor Marketing Group Limited (“the Promoter”) across three of its major brands (Bottlemart, Sip’n Save and Western Cellars). There is one weekly prize and one grand prize across those three brands.
For example, the winner of the major prize for AFL will be the most successful tipper from the total population of tippers throughout the Eligible States who have entered via any of the Promoter’s three brands. The total amount a person could potentially win is AUD14,400.
The weekly prizes are valued at AUD200 each and the major prizes at AUD10,000 each.
· AFL competition commences March 26 (Game 1)
· Major Prize: AUD10,000 payable to the winning participant by cheque to be collected from the Participant’s nominated liquor outlet
· Weekly prizes: AUD200 payable to the winning participant by Electronic Funds Transfer to their bank account
Weekly winner’s details will appear on the Promoter’s websites.
All participants must be aged 18 years or more and may be required to provide proof of age at the Promoter’s absolute discretion.
The competition is open to all persons over 18 years except employees and their immediate families of Liquor Marketing Group and related companies, Global Omni Pty Ltd and liquor outlets participating under the Promoter’s three brands.
The AFL has 26 rounds in total - 22 regular season rounds and 4 finals rounds. The weekly tipping prize will relate only to the regular season rounds. The Season (major) prize will relate to all rounds – regular season and finals. Consumers may enter in any week.
The Weekly winner will be the week’s top tipper
1. The weekly winner will receive a congratulatory telephone call from a representative of the Promoter and at this time they will be asked to provide EFT details for payment of AUD200 to their bank account.
The Grand Prize winner
The Grand Prize winner will be the top tipper after all AFL rounds (regular season and finals).
1. The winner will receive a congratulatory telephone call from a representative of the Promoter and at this time, arrangements will be discussed with them for collection of the prize from their nominated liquor outlet and a for publicity photographs.
2. A cheque will be arranged in winner’s name.
3. The Promoter’s representative will meet the winner, present the cheque and have photographs taken.
The photographs will be used for publicity/marketing purposes, unless the winner specifically advises the Promoter to the contrary.
In the weekly and major competitions if there is more than one winner, the winner will be chosen by a “count back”, as follows:
a) The most tipped full rounds, if still a tie then
b) The most tipped away games, if still a tie then
c) The most successful tipper going back in reverse chronological order (that is, the first correct entry lodged by time and date is declared the winning entry), until the tie is broken
d) If still tied the prize will be shared in equal proportions by all tied Participants who are still standing after the process in (c) above.

TERMS AND CONDITIONS OF ENTRY FOR RESIDENTS OF VICTORIA
1. Information on how to enter, scoring and prizes forms part of these Terms & Conditions of Entry. Entries and Participants not complying with these Terms & Conditions of Entry are ineligible and the Promoter reserves its absolute right to disqualify any Participant from the Promotion if any entries do not comply with these Terms & Conditions of Entry. Entry into any Promotion is deemed to constitute acceptance of these Terms & Conditions of Entry.
2. In these Terms & Conditions of Entry, unless the contrary intention appears, the following words and phrases have the meanings set out opposite them:
"Away Team" means the team that is listed by the AFL governing body as playing away from their home ground. If the AFL does not nominate an Away Team, the Away Team will be nominated at the discretion of the Promoter;
“Eligible States” means New South Wales, Victoria, Queensland, South Australia, Australian Capital Territory, Northern Territory and Tasmania.
"Match" means a single game between member teams of the AFL, in a Season;
"Participant" means a person who is eligible to participate in the Promotion and registers for or participates in the Promotion;
"Promotion" means this tipping competition conducted amongst Participants who register to participate in that particular promotion, for any Season of Matches run on the Website, whereby winning entries are based on the Results of Matches at the conclusion of the AFL Season;
"Results" are the results of Matches as officially determined by the AFL in accordance with the rules of the AFL, following the completion of a Round;
"Round" means a round of Matches in the AFL conducted during the AFL Season;
"Season" means the series of home and away games (or series of Matches as indicated otherwise on the Website) for the AFL as listed in the "Tipping" area of the Website;
"Score" means the allocation of points to a Participant for the correct selection of winning teams;
"Website" means the Website of the Promoter accessible on the Internet through the World Wide Web via the address set out at the end of these Terms & Conditions of Entry.
3. The Promotion is open to residents of Eligible States (and other countries where the law allows residents to enter promotions of this nature) who are aged 18 years or more. Employees of the Promoter and its agencies and participating liquor outlets associated with this Promotion and their immediate families are ineligible to enter. Entry into the Promotion is free. Each person may only register once. A Participant may only register their own personal details for individual participation in the Promotion. Each registered Participant may only place one set of tips per Round in each Code/Season. If there is a dispute as to the identity of an applicant or Participant, the Promoter reserves the right, in its sole discretion, to determine their identity.
4. The Promotion commences 26 March 2009 at 00:01 (AEDT) and will continue until 2 October 2009 ("Promotion Period") at 23:59 (AEST). Registrations for each Season and tips for each Round close on the times and dates as advertised on the Website, which will be during the Promotion Period.
5. To enter the Promotion, a Participant must first register as follows:
a) register their details via the on-line registration form located on the Website www.bottlemart.com.au
b) login to the Website with their username and password for an existing registration;
6. Participants who enter via the Website must subscribe to the free weekly email reminders to participate. Participants will be required to fully complete the demographic questions as prompted to be eligible for the Weekly Prizes.
7. Entry into the Promotion is considered to occur when a Participant submits one or more tip(s) for any of the Matches available for any Round.
8. The Promoter, however, reserves the right not to accept registration for any Participant if the registration contains anything slanderous or defamatory or is otherwise objectionable in any way, as determined by the Promoter in its absolute discretion. Likewise, the Participant's participation in the Promotion may be withdrawn due to objectionable conduct during the course of the Promotion, or after the Promotion has ended but before the prizes have been awarded, at the Promoter's absolute discretion.
9. For each Round, each Participant must then make a selection of the teams the Participant tips to win and submit that entry via the Website in the manner and within the time frames set out on the Website
10. A draw cannot be selected as a Match selection.
11. A Participant may make or change a tip for a given Match in a Round at any time up to 23:59 AEDT on the day before the published scheduled day for that Match.
12. Participants will be allocated one (1) point towards their Score for each correct selection of a Match. In the event of a Match in a given Round being drawn, cancelled, abandoned, not completed or not played for any reason and/or a Result is not officially declared within three (3) days of the date the Match was originally scheduled to be played, it is treated as a win for both teams competing in that Match for the purposes of calculating each Participant's Score.
13. If a Participant:
a) does not submit a tip for a given Match in a Round, then the Participant's tip for that Match will be deemed to be for the Away Team. If no Away Team is allocated, then no tip is allocated;
b) enters the Promotion after the commencement of the first Round, then the Participant's tips for those Rounds that have been completed will be deemed to be for the Away Teams, and the Participant will be limited to a maximum number of tips for each such Round as defined on the Website. If no Away Team is allocated, then zero tips are allocated.
14. There are two (2) prize pools available throughout the season:
a) weekly prize ("Weekly Prize"); and
b) end-of-season prizes ("Season (major) Prize").
Weekly Prizes
15. There are 22 AUD200 Weekly Prizes for the ARL totalling AUD4,400. The last Weekly Prize for the AFL will be determined on 31 August 2009.
16. The weekly winner will be the highest ranking Participant for each week (from all Participants across the Promoter’s three brands across the Eligible States).
17. Weekly Prize winners will first be determined by the Participant's Score for that Round. Where multiple Participants have identical Scores, those Participants will participate in a “count back”, as follows:
a) in reverse chronological order (that is, the first correct entry lodged by time and date is declared the winning entry), until the tie is broken.
b) then by the most tipped full rounds
c) then by most tipped away games
18. If the tie can’t be broken the weekly prize will be shared in equal proportions by all tied Participants who are still standing after the process in Clause 17 (c).
19. Weekly winners will be contacted by telephone and arrangements made to credit the AUD200 prize to their bank account. Details will be published on the Website on the Wednesday following each round.
20. The total Weekly Prize pool value across Australia is AUD4,400.
21. With each tie break initiated the runner- up names will be recorded so that if a particular Weekly Prize has not been claimed by 7 December 2009, the Weekly Prize will be awarded to the runner up and so forth. If a Weekly Prize cannot be allocated, the Promoter will seek directions from the relevant State or Territory lottery authorities. The Weekly Prize winner will be notified by mail and contacted by telephone and their details will be published on the Website on 9 December 2009.
Season (Major) Prize
22. After the full season (regular season rounds and finals, including the grand final), where multiple Participants have identical Scores for the Season (Major) Prize, those Participants will participate in a “count back”, as follows:
a) first by their total Score for all Rounds;
b) then by the most tipped full rounds
c) then by most tipped away games
d) then if Participants are still tied, the score referred to in Clause 22 (a) will be reviewed, in reverse chronological order (that is, the first correct entry lodged by time and date is declared the winning entry), until the tie is broken.
23. If the tie cannot be broken, the weekly prize will be shared in equal proportions by all tied Participants who are still standing after the process in Clause 22 (d)
24. The Season Prize winners will be determined at Global Omni Pty Ltd, Unit 5/20 Smallwood Place Murrarie Qld 4172 at
14:00 on Friday 2 October 2009.
25. The Participant(s) with the highest total ranking after all 26 Rounds will be awarded all or a share of the AUD10,000 prize money.
26. The total value of the Season (Major) Prize pool across the Eligible States is AUD10,000.00.
27. Season (Major) Prize winners will be notified by mail and contacted by telephone and arrangements made for them to collect their prize by cheque for AUD10,000 at their nominated liquor store. During the presentation by a representative of the Promoter, publicity photographs will be taken of the winner receiving their prize. Details will be published on the Promoter’s Websites and appear in the Herald Sun Newspaper during the week commencing Monday 12 October 2009.
28. In the event that the Season (Major) Prize is not claimed by 14:00 AEDST on 9 January 2010, the prize will be awarded to the Participant who qualifies as the runner up for the Season Prize and so forth until the prize is claimed. If the Season (Major) Prize cannot be allocated, the Promoter will seek directions from the relevant State/Territory lottery authorities. The Prize winner will be notified by mail and contacted by telephone and their details will be published on the Website on 22 January 2010.
General
29. In the event that a prize winning Participant is unable or unwilling to accept their prize for any reason, or the prize is unable to be allocated within three (3) months of the results being determined, the Promoter will award that prize to the Participant who met the eligibility criteria and would have been deemed the prize winner had the original prize winning Participant not participated in the Promotion. Prizes are not transferable.
30. All prize winners will be notified by telephone and will be published on the Promoter's Website upon determination. In the case of any winners who have not provided an email address to the Promoter, these winners will be notified in writing by SMS and/or mail.
31. Any cost associated with accessing the Website is the Participant's responsibility and is dependent on their Internet service provider. A Participant electing to access the Website via wireless platforms for the purpose of registering for a Promotion and/or entering tips may be subject to content service fees imposed by its telecommunications provider. No revenue sharing or commission arrangements exist between the Promoter and the telecommunications provider in relation to any such transactions.
32. The Promoter reserves the right, at any time, to verify the validity of registrations and tips and the eligibility of applicants and Participants (including an applicant's or Participant's identity, age and place of residence) and to disqualify any Participant who submits a registration or tip that is not in accordance with these Terms and Conditions of Entry or who tampers with the registration or tipping processes. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
33. Except for any liability that cannot be excluded by law, the Promoter and its agencies associated with this Promotion (including their respective officers, employees and agents) are not liable and do not accept responsibility for:
a) a Participant's tips that are not received or which are received and subsequently corrupted or rejected by the Website server whether or not after receipt by the Promoter;
b) any lost, misdirected or corrupted emails, messages or other information to or from the Website;
c) any loss or damage whatsoever (including but not limited to direct, indirect or consequential loss) or personal injury suffered or sustained:
(i) in connection with a Participant's participation in the Promotion or the taking of a place or prize; or
(ii) otherwise relating to the conduct of the Promotion however caused, including but not limited to failure of the Website or incorrect or corrupted data supplied by the Promoter to a Participant.
d) any theft, unauthorised access or third party interference;
e) any tax liability incurred by a Participant or prize winner.
34. As a condition of accepting any prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity.
35. Information about Participants is used by the Promoter to assess and process registration in the Promotion. If an applicant does not provide the required information, the Promoter cannot process the registration. All entries become the property of the Promoter and will be entered into a database. Information emanating from the Participant's participation in the Promotion is used by the Promoter and its agencies associated with this Promotion, including but not limited to Global Omni Pty Ltd ABN 96 133 898 558 ("GO"), for the determination of winners and distribution of prizes, if any, awarded to a Participant. Participants consent to the publishing of their name and Score in the results section of the Website, on the WAP Site, in other promotional material as determined by the Promoter and/or Global Omni, and as otherwise set out in these Terms and Conditions of Entry of Entry. The Promoter will not be held responsible for any loss of reputation, status or otherwise in connection with a Participant's tipping selections and consequential results. It is a condition of entry that Participants consent to these uses and disclosures of their information. Information about Participants may also be used by the Promoter, its agents, contractors and related companies, for the purposes of carrying out marketing, planning, product development and direct mail, telemarketing and promotional campaigns unless a Participant otherwise withdraws their consent to the use of their information in this manner, in writing.
36. Notwithstanding the Promoter's rights to not accept or to subsequently disqualify a Participant, the Promoter will not be liable for any legal action arising out of any Participant’s name or postings on the Website being slanderous, defamatory or objectionable to the public at large, except for any liability that cannot be excluded by law. By participating in the Promotion, each Participant agrees to indemnify the Promoter, its agents, contractors and related companies from any legal action, claim or dispute arising in relation thereto.
37. In the event there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and no correspondence will be entered into.
38. The Promoter shall not be liable for any manufacturer defects in prizes or for any loss, damage or personal injury whatsoever which is suffered or sustained (including but not limited to indirect or consequential loss) as a result of taking a prize, except for any liability which cannot be excluded by law.
